Biometric Unlock Agreement
THIS BIOMETRIC UNLOCK AGREEMENT (hereinafter referred to as this "Agreement") is entered into between America Ugreen Limited (hereinafter referred to as "UGREEN" or "We") and the UGREEN NAS user (hereinafter referred to as "You") regarding your activation and use of Biometric Unlock to unlock and access the UGREEN NAS Safes. Before activating and using Biometric Unlock, please thoroughly read, fully understand, and accept all provisions of this Agreement, especially the BOLDED parts. Please contact us if you have any questions about this Agreement.
I. Definitions
- Biometric unlock data refers to unique physiological characteristics that can distinguish natural persons, including but not limited to Face ID and fingerprints.
- Biometric Unlock refers to a feature which encrypts your UGREEN NAS Safes password and stores it locally on your device (such as a mobile phone), enabling you to unlock and access your UGREEN NAS Safes via fingerprint or Face ID authentication. Biometric Unlock is designed solely to provide a convenient alternative for accessing your UGREEN NAS Safes. The Biometric Unlock option is displayed on the menu screen when you access your UGREEN NAS Safes on a device with the biometric unlock feature.
II. Rights and Obligations
- You acknowledge and agree that to activate and use Biometric Unlock to unlock and access your UGREEN NAS Safes, you need to operate as prompted to input or verify your biometric unlock data registered on your device and pass the identity authentication. Activating Biometric Unlock constitutes your authorization for UGREEN to invoke the APIs provided by the operating system (e.g., iOS, Android) on your device (e.g., mobile phone) to obtain anonymous authentication results ("Pass" or "Fail") for unlocking your UGREEN NAS Safes.
- You acknowledge and agree that activating Biometric Unlock requires a device with the biometric unlock feature. All information processing operations, including collection, storage, and matching of your biometric unlock data, are performed exclusively by the operating system of your device. Devices with the biometric unlock feature typically verify users' biometric unlock data against pre-registered biometric templates stored on them. UGREEN neither collects, stores, nor gains access to your fingerprint/Face ID templates. Your biometric unlock data is processed exclusively by the operating system of your device. UGREEN only receives anonymous authentication results ("Pass" or "Fail").
- After you enable the biometric unlock feature on your device and register you biometric unlock data on it as prompted, you may activate Biometric Unlock via the device's biometric unlock feature. The types of biometric unlock data available for authentication depend on the operating system of your device. For instance, certain device models do not support biometric unlock feature, or support authentication via Face ID rather than fingerprint.
- You acknowledge and agree that prior to activating Biometric Unlock, you have fully understood successful on-device biometric authentication allows direct access to your UGREEN NAS Safes without entering the password.
- You acknowledge and agree that Biometric Unlock via Face ID or fingerprint is available only on your own
device. You need to reactivate Biometric Unlock and agree to the terms and conditions of this Agreement
again if:
- Your current device is replaced; or
- You reinstall the UGREEN NAS client app or clear data stored locally on your device.
- You may disable Biometric Unlock on the client app and switch to password-based authentication. You may permanently disable Biometric Unlock on the system settings screen of your device. Disabling Biometric Unlock does not affect core functionality of the UGREEN NAS Safes on your device.
III. Warnings
- Please only enable Biometric Unlock on your own devices and issue operational commands using your own biometric unlock data. Operational commands issued upon biometric authentication on your device shall be deemed your explicit intent, and we will perform such commands accordingly. Please safeguard your device on which you have activated Biometric Unlock to prevent unauthorized individuals from registering biometric unlock data on your device. Before activating Biometric Unlock feature on your device, please verify and confirm no biometric unlock data from other individuals is registered on the device. Please promptly disable biometric authentication using biometric unlock data registered by others on your device (if any) or remove such data to prevent unauthorized access to and operations in your UGREEN NAS Safes. You acknowledge and confirm that UGREEN assumes no liability for biometric data leakage or unauthorized access to your UGREEN NAS Safes resulting from improper device management, provided that UGREEN has fulfilled its obligations of taking corresponding technical safeguard measures.
- We recommend that you choose secure and reliable phones or devices. If you have concerns about the biometric unlock feature on your phone or other devices, we recommend that you unlock and access your UGREEN NAS Safes through password-based authentication or other authentication methods.
- You might not be able to use Biometric Unlock to unlock and access your UGREEN NAS Safes on your phone or other devices connected to the internet due to malicious attacks, malware, viruses, operating system failures, or other reasons. In such cases, we suggest that you access your UGREEN NAS Safes by entering your account credentials.
- We will notify you through appropriate channels prior to terminating Biometric Unlock due to technical upgrades or according to the requirements of relevant laws and regulations, excluding immediate termination due to security emergencies. In such case, please access your account using credentials and manually disable Biometric Unlock on your device.
IV. Personal Information Protection
UGREEN attaches great importance to the protection of your personal information and commits to safeguarding it with stringent measures. UGREEN shall protect your personal information in accordance with prevailing laws and regulations, the provisions of the UGREEN NAS Privacy Policy, and other agreements with you.
V. Amendments
- To enhance user experience, we continuously update our services, including feature upgrades, policy updates, and content updates, which may prompt corresponding amendments to this Agreement. We will notify you of any amendments hereto via public announcements, in-app notifications, SMS text messages, pop-up messages, or other means. The amended terms shall become effective on the date specified in such notification.
- If you do not agree to the amended terms, you have the right to cease using and disable Biometric Unlock. Your continued use of Biometric Unlock shall be deemed your acceptance and acknowledgment of the amendments hereto.
VI. Miscellaneous
This Agreement constitutes an integral part of the UGREEN NAS User Agreement. Any matters not covered herein shall be subject to the provisions of the UGREEN NAS User Agreement.
